What is Public Interest Litigation?
Public Interest Litigation or PIL is the process of filing lawsuits and petitions in court pertaining to issues of public interest and social significance. These cases are filed by public-spirited citizens, NGOs, institutions, government bodies or the court itself.
PIL allows citizens to directly approach the highest courts to seek legal remedy for matters of broad public concern. Courts can also take suo moto cognizance of issues based on news reports or third party information.
Evolution of PIL in India:
The concept of PIL emerged in India in the late 1970s. It relaxed the locus standi rule that required the petitioner to be an affected party. This enabled public-minded individuals to file cases on behalf of marginalized sections.
Over the years, PIL has helped provide access to justice for oppressed communities and strengthened environmental, human rights and anti-corruption laws in India through landmark judgements.
